This privacy policy (the "Policy") explains the personal data that ParkVision collects and processes and for what purposes it is collected and processed. We may also disclose such information in response to a law enforcement request, or when we believe it is necessary to investigate, prevent, or take action regarding illegal activity, suspected fraud, a situation that poses a potential threat to human physical safety, violations of our terms of use, to verify or to enforce the rules for using our website and applicable laws, or in any other case in accordance with applicable laws.

Although we take all necessary measures to prevent unauthorized disclosure of information, we cannot guarantee that personal information received by us will never be disclosed to the extent inconsistent with this confidentiality agreement.

3. Cookies

We use cookies on our own domains and subdomains to find out how the site is used and to improve the content and offerings on our sites. For example, we may use cookies to identify you on our web pages. We also use third-party analytics packages for our public pages, which can set a cookie on your computer. These third-party ad servers may use cookies, web beacons, transparent gifs, and other similar technologies to serve advertisements and measure and research the effectiveness of advertisements. The use of such technologies by these third-party ad servers is subject to their own privacy policies and is not covered by the terms of our privacy agreement.

We understand and accept responsibility for data protection. We use strict access control mechanisms, network isolation and do not share data with third parties to ensure that User Data is only accessible to authorized personnel.

By installing and running the software accompanying this User Agreement ("Agreement") and agreeing to the terms of the Agreement at the time of installation, you agree to and become a party to this Agreement. If you do not agree to be bound by all of the terms of this Agreement, do not install the software. The software covered by this Agreement is the ParkVision software.

1. General

Any rights not expressly granted by this Agreement are reserved. This Agreement constitutes the entire agreement between you and the Licensor with respect to this subject matter and supersedes any and all prior or contemporaneous oral or written agreements, statements, negotiations, any additional terms of any offer, order, or other similar communication between the parties. If any part of this Agreement is found to be invalid, unenforceable, or invalid, that part will be deemed in breach and will not affect the validity of the other provisions of the Agreement. Failure by either party to enforce any provision of this License Agreement will not be deemed a waiver of future performance of that or any other provision.

ParkVision site may contain links to third-party sites. ParkVision does not control the sites of third parties, links to which are published on the site is not responsible for them and in no way endorses the information, advertising, content, products, or services on these sites. We strongly encourage you to review the terms and conditions and privacy policies of any third-party websites or services that you use.

2. Copyright and trademark rights

ParkVision software is copyrighted by the law. You must not use the Software in any way that might jeopardize or infringe its copyright. Unless specifically permitted by the terms of this Agreement, copying, reproducing, altering, modifying, and decompiling the software, as well as transferring it from mechanical code, reanalyzing it, or creating on its basis any derivable works by processing is strictly prohibited. You may also not resell, borrow, assign, transfer or lease the Software to any person.

3. Protection of intellectual property

ParkVision site and software and all content, including but not limited to text, images, graphics, or code, are the property of ParkVision and are protected by copyright, trademarks, database, and other intellectual property rights. You may display and copy, download or print portions of material from various parts of ParkVision for your own non-commercial use only. Any other use is strictly prohibited and may violate copyrights, trademarks, and other laws.

4. User data

“User Data” means any data that you download, store, retrieve or otherwise make available through ParkVision. You retain all rights to your data. You agree to grant ParkVision permission to store, retrieve, back up, restore, and otherwise copy your data so that we can provide you the service when you use the site or the ParkVision software.

5. Restrictions on Use

You must use this Software in accordance with all applicable laws and not for any illegal purpose. Each licensed copy of ParkVision may be used on a single computer unless otherwise permitted here. “Use” of the Software means that you have downloaded, installed, or run the Software on a computer or similar device. You may make one copy of this Software for backup purposes, provided that you only have one copy installed on one computer. Others may not use or install your licensed copy of this Software. Transferring, sublicensing, networking, selling, or distributing copies of this licensed Software is strictly prohibited without the prior written consent of the Licensor. It is a violation of this Agreement to assign, sell, share, lend, lease, lease, borrow, network, or transfer the use of this licensed Software.

6. Potential Implications of Using ParkVision

The operator of ParkVision is not responsible for any possible malfunctions in the operation of the PC, operating system, or user devices.

7. Limitation of Liability

ParkVision is not liable for any loss or damage, consequential, incidental, special, or punitive damages, including but not limited to economic damage, loss or damage to electronic media or data, or other material and non-material damages.

8. Termination of use

This Agreement will automatically terminate if you fail to comply with its terms, without prejudice to ParkVision's rights to compensation for damages under applicable law.

The service does not give any guarantees, representations regarding the website and related technologies and software. Any warranties, terms, and conditions allegedly applicable are excluded to the fullest extent permitted by law.

If you violate any of the terms of this Agreement and ParkVision decides not to take immediate action or to act at all, ParkVision will still be entitled to all remedies at any later date or in any other situation where you violate these conditions. ParkVision does not waive its rights and is not responsible for any alleged violation of these Terms due to circumstances beyond its control. A person who is not a party to these Terms is not eligible for enforcement.

You may not assign, sublicense or otherwise transfer any of your rights under the terms of this Agreement.

9. Legislation

The terms of this Agreement are governed by, interpreted, and applied in accordance with the current legislation of the Russian Federation.

If any provision of the terms is held invalid or unenforceable by a court of competent jurisdiction, then all other provisions of these terms will remain in effect. The terms of the Agreement constitute the entire agreement regarding the ParkVision Site and Software and supersede any prior agreements, oral or otherwise.

10. Changes

ParkVision reserves the right, in its sole discretion, to change or replace the terms of this Agreement at any time. If the revision is material, we will use reasonable efforts to provide notice prior to the new terms being effective. What constitutes a material change will be determined at our discretion.

By continuing to access or use the ParkVision site and software after these changes take effect, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the ParkVision site and software.
